– All Cemetery Districts ensure their Endowment Care signage complies with Health and Safety Code section 8741. Response to Finding 3 The District respectfully disagrees that it fails to comply with requirements for posting Endowment Care signage. The Solano Cemetery District is formed and operates pursuant to the Public Cemetery District Law ("PCDL"), Health & Safety Code sections 9000, et seq. The PCDL contains no endowment care posting requirement of any nature. The Grand Jury erroneously relied on Health & Safety Code section 8741 which applies only to private cemeteries, not public cemeteries (city- and county-owned) or public cemetery districts. Nonetheless, the District has reviewed its placement of various endowment care signs and is making any adjustments or adding additional signage deemed necessary.

- Not all Cemetery Districts are fully compliant with legal requirements to post certain categories of data on their websites. This results in failure to provide the public with the required easily accessible and accurate information about the district.

- Non-compliant Cemetery Districts review Government Code 53087.8 and ensure they comply with website requirements. Response to Finding 5 The District concurs with Finding 5. The Enterprise System Catalog already has been updated on the District's website, and Cemetery Rules and Regulation are posted on the website. In addition, the District has made this information downloadable and more easily accessible. In addition, the District is currently working to ensure that its website meets all of the requirements set forth in Government Code section 53087.8, including but not limited to Government Code section 54954.2.

- Solano and Vacaville Cemetery Districts have not maintained up-to-date submissions of "Public Agencies' Statement of Facts Roster of Public Agencies Filing." This results in inaccurate information and prevents State and County governments from maintaining and providing accurate public records.

- Solano and Vacaville Cemetery Districts comply with Government Code section 53051 by filing the required Statement. Response to Finding 6 The District agrees with Finding 6. The District's "Statement of Facts Roster of Public Agencies Filing" was not up to date. The District has now updated the "Statement of Facts Roster of Public Agencies Filing" and filed it with the Secretary of State on July 25, 2024, in compliance with Government Code section 53051. The District has also updated its policies and procedures to ensure that this filing is kept up to date in the future: The Solano Cemetery District, its Trustees, and employees appreciate the service given by the members of the Grand Jury. We appreciate the Grand Jury calling these matters to our attention and will take steps necessary to rectify any failures of performance.
