R1Page 4It is recommended that the city council, by motion, authorize the mayor to execute and submit a response to the Civil Grand Jury's report on protecting elder and dependent adults from abuse. Background: Each year the Santa Clara County Superior Court convenes a Civil Grand Jury (CVJ) for the purpose of reviewing the functions of government within the county. The CVJ typically reviews an aspect of local government operations within the county and drafts a report with findings and recommendations. Discussion: The CVJ report this year relates to protecting elder and dependent adults from abuse and advocates a revision to the county-wide policy on this issue as used by law enforcement. The CVJ report applies to all local governments within the county that operate law enforcement services that investigate elder abuse claims. The CVJ did not make any findings related to the Gilroy Police Department, but did offer a recommendation that he Gilroy Police Department advocate for revision of the Elder and Dependent Adult Abuse Protocol for Santa Clara County Law Enforcement through the county police chiefs association. The administration and police department concur with the CVJ recommendation and will advocate for revision of the county- wide policy. A response letter has been drafted consistent with Penal Code §933(c) for review by the council and signature by the mayor and is recommended for approval for submission to the Superior Court. Fiscal Impact: There is not a fiscal impact associated with the recommended action. 17
